SMSF Succession

Self-Managed Superannuation Fund (SMSF) succession planning is all about the trustees and members of a SMSF planning for the events that will occur and have a major impact on the members, and by default, the fund.  The most obvious major event would be the death of a member where their superannuation assets need to be distributed.

The trustees need to ensure that the governing rules of the fund will adequately ensure the wishes of the members are able to be carried out upon their death.  There are a range of events and circumstances that will have a potential impact on the fund and its members.  We recommend clients with SMSF’s contact CLO Lawyers regarding the structure and governance rules of the fund to ensure the wishes of the members are able to be accommodated and that the members are not disadvantaged by them.
