The commencement of any litigation could potentially involve substantial costs for either or both parties.  It is a prudent course of action to resolve any dispute by negotiation before embarking on the more formal option of litigation and court processes.  

The desired outcome for any negotiation involves coming to a collective agreement that all parties will accept and agree to in a formal settlement of the dispute.  Negotiated outcomes by their very nature mean that one or both parties will not get everything they wanted, but have come to a point they are prepared to accept.
