Law Suits

In the event a dispute is unable to be resolved through the exchange of correspondence and any formal negotiations, either party to a dispute may initiate formal legal action against the other.  Litigation (law suits) involves resolving disputes through the formal court system.  There is a lengthy and complex process to follow before s actually appear before a court, and your CLO lawyer will advise you on the process involved and your options.  

Simply believing you have a strong case may not result in a positive outcome for you.  There are a range of factors to be considered before and during the litigation process.  These include but are not limited to:

a) Is the dispute suitable for litigation?

b) Have you thoroughly explored and negotiated a potential outcome through letters of demand or formal negotiations?

c) The availability of relevant and key documentation 

d) Availability of relevant witnesses
